Terms of Service

These Terms of Service ("Terms") are a legal agreement between you ("you", "your") and CrowdHum LLC, a Virginia limited liability company ("CrowdHum", "we", "us"). By accessing or using the CrowdHum website, hosted service, or any related apps (collectively, the "Service"), you agree to these Terms. If you don't agree, don't use the Service.

1. The Service

CrowdHum is a live audience-polling tool. Presenters create polls and sessions; audience members vote anonymously from their phones; votes are visualized in real time.

We may add, change, or remove features at any time. We'll give reasonable notice of material changes that affect paying customers.

We may suspend or terminate accounts that violate this section, with or without notice.

5. Your Content

You own your content. Poll questions, choices, branding, and vote data you create or collect remain yours.

You grant us a worldwide, non-exclusive, royalty-free license to host, copy, transmit, display, and process your content solely to operate and improve the Service (including generating anonymized, aggregate statistics, and performing AI-assisted synonym consolidation for word-cloud polls).

You represent that you have the rights to the content you upload and that it does not infringe or violate any third party's rights.

6. Voter Anonymity

Voters participate anonymously. You, as a presenter, agree not to attempt to re-identify individual voters, correlate vote data with external identifiers, or use the Service for surveillance of an audience against their reasonable expectations.

7. Third-Party Services

The Service relies on third parties including Google Firebase (auth, hosting, database), Stripe (payments), and Resend (email delivery). Their terms and privacy policies apply to your use of those components. We are not responsible for third-party outages or changes outside our control.

8. Beta Features

We may label features "beta", "preview", or similar. Those features are provided as-is, may change or be removed without notice, and are excluded from any service-level expectations implied elsewhere in these Terms.

The CrowdHum name, logo, visualizations, software, and design are owned by CrowdHum LLC and protected by copyright, trademark, and other laws. These Terms do not grant you any right to use our brand assets except as needed to use the Service.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or free of harmful components, or that any data will be preserved or accurate.

12. Limitation of Liability

To the maximum extent permitted by law, CrowdHum LLC and its owners, employees, and contractors will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for lost profits, revenue, goodwill, or data, arising out of or related to your use of the Service, even if we have been advised of the possibility of such damages. Our total aggregate liability for any claim arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).

13. Indemnification

You agree to defend, indemnify, and hold harmless CrowdHum LLC from any claims, damages, or expenses (including reasonable legal fees) arising out of (a) your use of the Service, (b) your content, or (c) your violation of these Terms or applicable law.

14. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to its conflict-of-laws rules. You and CrowdHum agree to the exclusive jurisdiction of the state and federal courts located in Richmond, Virginia for any dispute that is not required to be resolved through other means under applicable law.

Each party waives any right to a jury trial to the extent permitted by law. Class actions and class arbitrations are not permitted; claims must be brought individually.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we'll post a notice on the Service or email registered presenters at least 14 days before the change takes effect. Continued use after the effective date means you accept the updated Terms.
